LobbyFix, S.A.P.I. of C.V. located and incorporated in Guadalajara, Jalisco, Mexico announces and places at your disposal the present Terms and Conditions, which regulate the access and/or use that you give, from any country of the world, in a non-limiting manner, to the applications, web pages, content, products and services, made available by LobbyFix, through the site www.lobbyfix.com (collectively and hereinafter the “Site”) or any of the applications or plugins thereof, as well as queries, notices, advice, notifications, including those made personally, by email, postal mail, instant messaging, parcel service, fax, and / or by telephone. If you do not agree with the following Terms and Conditions, you must not access and/or use the Site under any circumstances. PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING THE SITE OR CONTRACTING THE SERVICES.

DEFINITIONS

1. LOBBYFIX: REGISTROS DIGITALES EN LA NUBE S.A.P.I. de C.V.
2. CLIENT: Person or organization that uses LobbyFix in its facilities.
3. VISITOR: Person who intends to access or access the facilities of the CLIENTS.

SERVICE DESCRIPTION. LobbyFix facilitates the control and registration of Visitors in different facilities of the Clients. Through the Site, the Client may, without limitation, register Visitors, send QR codes to the Visitors’ emails, create lists to prohibit the entry of certain Visitors, receive notifications of the Visitors’ arrival. On the other hand, Visitors, through our Site, may provide personal information, capture personal photographs, among others (know our Privacy Notice). YOU ACKNOWLEDGE THAT LOBBYFIX DOES NOT PROVIDE SECURITY SERVICES OF ANY KIND.

USE OF OUR SERVICES. The access, the use of our Services, browsing, sharing, obtaining and/or entering information and/or documentation to the Site implies the acceptance and knowledge of the content, object, commercial and legal scope of the Terms and Conditions. And full acceptance without reservations of each and every one of the provisions included and their respective and appropriate modifications.

In case of a specific event, activity or promotion in particular, additional conditions may apply to certain Services related to these points, which will be communicated to you at the time.

YOUR ACCOUNT ON OUR SITE. If you use an account on the Site, you must be at least 18 years old or the legal age of majority in your jurisdiction, you acknowledge that it is your responsibility to carry out any activity that is developed with or through that account, and accept the conditions established in LobbyFix Privacy Notice, available at  Privacy Notice.

SERVICE POLICIES. LobbyFix offers a service backed by the highest standards of quality from a commercial point of view, seeking at all times the satisfaction of our users, customers and visitors, with highly trained staff to handle all matters related to the use of the Site and our Services.

PRIVACY AND COPYRIGHT POLICIES. LobbyFix undertakes not to use or disclose information and/or documentation that is confidential, provided by the Client or Visitor through the Site or by any other means, except those for purposes detailed in the Privacy Notice, which is available in our Privacy Notice.

INTELLECTUAL PROPERTY. The use of our Services does not make you the owner of any of the intellectual property rights or the content you access, LobbyFix being the sole and legitimate owner of all industrial property and author rights related to the Site and the Services. Reproduction, copy, download or any other type of activity is strictly prohibited without prior authorization from LobbyFix.

GUARANTEES AND DISCLAIMERS OF LIABILITY. LobbyFix offers Services with a level of competence and reasonable diligence from a commercial point of view, however, does not offer guarantees in relation to the Services.

The Site is provided by LobbyFix “as is” and “as available.” LobbyFix does not express any representation or guarantee of any kind, express or implicit, in relation to the operation of the Site, information, content, materials or products included. You expressly agree that the use of the Site is at your own risk. LobbyFix reserves the right to remove or delete any information from the Site, at any time, at its sole discretion. Neither LobbyFix, nor its suppliers or distributors offer specific guarantees about the Services. LobbyFix excludes all warranties to the extent that current laws permit.

In accordance with the Terms and Conditions, LobbyFix does not assume any type of responsibility towards any person, derived or that could derive from the Services, navigation on the Site, queries, clarifications and/or any other kind of response granted by the party of LobbyFix by any means of communication.

You agree to leave LobbyFix, its shareholders, subsidiaries, affiliates, officers, directors, employees, advisors, agents, representatives and/or any other person related to LobbyFix, in a safe and secure manner, of any liability that may be imputed to it, by virtue of its and/or in relation to the Site, the provision of the Services or any other derivative of these Terms and Conditions.

In the event that LobbyFix is ordered to be liable for any matter by any competent court, it will be limited in all cases to the amount paid in consideration for the Services or products that are the subject of the dispute.

SERVICES AND CONTENT OF THIRD PARTIES. You acknowledge that LobbyFix, for the purpose of providing the Services and the Site, may contract third parties, such as, for example, parcels, payment gateways, distributors, among others. LobbyFix, under no circumstances, will be responsible for the services provided by these third parties.

COOKIES POLICY. LobbyFix uses cookies and similar technologies that are stored on your computer’s hard drive automatically, which are generated when you access the Site. Cookies allow us to recognize our users in order to provide a better service. You can delete cookies whenever you want or change the settings of your Internet browser, activating a notification when you receive cookies so you can accept or reject them.

ABOUT THESE CONDITIONS. LobbyFix may modify at any time, in whole or in part, at its discretion, the Terms and Conditions. In case of modification, the continuation of the use of the Site and the Services will be considered as the acceptance of these. Please review our other policies posted on the Site.

LobbyFix at any time may terminate, change, suspend or discontinue any aspect of the Site or the Services, and may restrict, suspend or terminate your access to the Site without notice or liability.

JURISDICTION. The Terms and Conditions are governed by the legislation in force in Mexico. You expressly waive the jurisdiction of your location and submit to the Judges and Tribunals of the city of Guadalajara, Jalisco.

RECOGNITION. By using the Site and the Services, you declare to know in detail the content and scope of these Terms and Conditions, and you acknowledge being bound by the provisions established in them.
